Verify your customers' ages

From October 1, 2024, any online business that sells alcohol and tobacco in Denmark must verify customers' ages. Previously, customers only needed to tick a box to self-report their age without having to verify it. The new law makes digital age verification as secure as in physical stores, where a cashier can request a valid ID.

What does the new age verification law say?

The law was passed on June 4, 2024. Its full title is "Law on Amendments to the Law on Tobacco Products, the Law on Electronic Cigarettes, and the Law on the Prohibition of Selling Tobacco and Alcohol to Persons Under 18."

 

It is part of a plan to reduce the underage consumption of tobacco, nicotine, and alcohol

How does the new law affect online alcohol sales?

The new law requires online retailers of alcoholic beverages to implement a digital age verification system.


This system must ensure that the customer is at least 16 years old for alcoholic beverages with an alcohol content of 1.2% to 16%, and 18 years old for alcoholic beverages with an alcohol content of 16% or higher at the time of purchase. This aligns online alcohol sales with in-store sales, where age verification is performed by the seller.

What does the new law mean for online retailers of tobacco?

The new law requires all online retailers of tobacco, tobacco substitutes, and herbal smoking products to implement a digital age verification system.


This system must ensure that the customer is at least 18 years old at the time of purchase. This aligns online tobacco sales with in-store sales, where age verification is performed by the seller.

When does the law take effect?

The law takes effect on July 1, 2024, with certain provisions coming into effect on October 1, 2024.

What is an age verification system?

An age verification system is an IT system that electronically verifies the consumer’s age in accordance with the established age limits.

What are the consequences of not complying with the law?

Violation of the law may result in fines for the retailer. If the violation is severe or repeated, it will be considered an aggravating factor.

What must I do as an online retailer to comply with the law?

As an online retailer, you must implement a digital age verification system that effectively verifies the buyer’s age at the time of purchase. This system must be operational no later than October 1, 2024.
